The ACT Government is reviewing feedback received on how reforms made to the Lease Variation Charge framework are flowing through to community and development outcomes, and whether further improvements to the framework are warranted.

During the consultation from 14 September to 17 October, those involved in residential or mixed-use developments and the broader community were able to have their say by sending a written submission to LVCReview@act.gov.au.

In making a submission, stakeholders were encouraged to consider a number of questions set out in the consultation paper, and include detailed evidence including industry data or project costings in support of the views and arguments provided.

We are looking at:

The Lease Variation Charge is applied when a lease holder receives permission from the Government to vary their lease to enable new or additional development.

The review is considering:

• The Lease Variation Charge and remissions as they apply to residential and mixed use developments
• Simplifying Lease Variation Charges and increasing consistency across lease types
• The combined impact of the Lease Variation Charge and zoning or planning rules on the financial viability of redevelopment, particularly in relation to the codified charges updated in 2017
• Aligning the Lease Variation Charge with housing affordability, housing supply and planning objectives
• Simplifying residential schedules and extending application of codified charges

It is also considering how the Lease Variation Charge aligns with the government’s urban renewal and housing supply priorities.
